for services of the aspirant IFMGA | UIAGM mountain guide

1. Introductory Provisions

These General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between the client and:

By entering into a contract with the aspirant mountain guide, the client confirms that they have read and unconditionally agree to these GTC.


2. Contract Conclusion

  • These GTC define the rights and obligations of both parties. By entering into the contract, the client acknowledges and agrees to the terms.
  • The client makes an offer by filling out the booking form, or by sending an email or message.
  • The contract is concluded when the booking is confirmed by the aspirant mountain guide (via email, phone, or message).
  • The contract is binding unless both parties agree otherwise.

3. Price and Payment

  • After approval of the booking, full payment (100%) in advance is required.
  • The price includes guiding services and possibly transportation and other costs unless otherwise stated in the contract or event description.
  • Payment must be made within 14 business days of booking confirmation, unless otherwise agreed.
  • Reservations for huts or other accommodations are made only after payment is received.
  • If the price is stated in EUR, invoicing is done in CZK based on the ČSOB exchange rate – selling rate.

4. Cancellation Policy

Client’s Withdrawal:

  • The client has the right to withdraw from the contract within 14 days, as per § 1829 of the Civil Code.
  • 31 or more days before the event: full refund (minus non-refundable costs, e.g., hut reservations).
  • 30 days or less before the event: 100% cancellation fee (no refund).
  • Any non-refundable costs (e.g., hut bookings) must be paid even if the event is canceled more than 31 days in advance.

Cancellation by the Aspirant Mountain Guide:

  • Full refund (100%) of the paid amount.
  • If the minimum number of participants (75% of the stated maximum) is not met, the event may be canceled with a full refund.

5. Conditions for the Event

  • In case of bad weather, the aspirant mountain guide will choose an alternative (e.g., different route, more instruction, other summit).
  • Safety is always the top priority. The guide has the right to change the route, call off the event or retreat if necessary (due to weather, poor fitness, etc.). The price remains unchanged in such cases.
  • Inappropriate behavior by the client (e.g., ignoring instructions) may lead to immediate termination of the event without refund.

6. Client’s Health Condition

  • The client must inform the aspirant mountain guide of any health conditions that could affect safety (e.g., epilepsy, heart conditions, asthma) within two days of signing the contract.
  • If the condition arises later, the client must inform the guide within two days of onset, and no later than the day before the event.
  • Failure to do so makes the client liable for any resulting damages to the guide, other clients, or third parties, and the client must cover related costs.
  • If health problems arise during the event, the client must report them immediately.
  • The client is responsible for any damage caused by concealing health conditions.

7. Liability and Insurance

  • Mountaineering, ski touring, and other high-altitude activities inherently carry risks, including injury or death, even without any fault on the part of the guide.
  • The mountain guide is not liable for damage to life, health, or property if such damage could not have been prevented even with maximum effort and due care.
  • The guide is not responsible for unavoidable risks.
  • The aspirant guide has professional liability insurance.
  • The client must have their own insurance covering medical treatment and mountain rescue.

9. Equipment Requirements

  • All participant equipment must be in full working order.
  • A gear list is provided with each event.
  • The guide reserves the right to inspect the gear.
  • In case of defects, the client may be asked to fix the issue. Failure to comply may lead to cancellation without refund.
  • The client is responsible for the technical condition of their equipment.

10. Gift Vouchers

  • Vouchers are valid for 1 year from the date of purchase.
  • The validity can be extended by paying the difference to the current price.
  • It is possible to pay extra for additional participants based on the current price.
